Tugas BPH Migas Bukan Awasi Penyaluran BBM Subsidi Di SPBU

WWW.EMLIINDONESIA.COM - Kepala BPH Migas, Andy Noorsaman Sommeng, menegaskan tugas pelaksanaan pengawasan penyaluran Bahan Bakar Minyak (BBM) subsidi di Stasiun Pengisian Bahan Bakar Umum (SPBU), seharusnya bukan tugas BPH Migas.




Tetapi, lanjut Andy, badan usaha penyaluranlah yang memiliki tugas melakukan pengawasan. Sesuai dengan Standard Operational Procedure (SOP) pelaku usaha di SPBU. Mengingat, BPH Migas tidak mengatur SOP masing-masing badan usaha di setiap SPBU.




Andy menjelaskan, dalam undang-undang disebutkan kalau tugas dan peran BPH Migas adalah melakukan pengawasan kegiatan bisnis badan usaha yang mengantongi izin penyaluran BBM subsidi.




Karena itu, seharusnya lembaga yang dipimpinnya tidak memiliki kewajiban untuk melakukan pengawasan penyaluran BBM subsidi di SPBU.




"Di seluruh dunia, pengawasan penyaluran BBM subsidi di SPBU dilakukan oleh badan usaha itu sendiri. Terlebih kalau pelaku usaha yang bisnis disektor ini adalah perusahaan terbuka. Sehingga, mereka memiliki kesadaran dan kewajiban untuk mengawasi setiap lini bisnisnya," cetus Andy Noorsaman.




Ini karena menyangkut soal kredibilitas pelaku usaha dalam menjalankan unit bisnisnya. Sehingga, lanjut Andy, kalau pelaku usaha tersebut memiliki kinerja yang bagus maka perusahaan akan mendapatkan reputasi positif.




Sementara, lanjut Andy, pihaknya hanya berperan lebih kepada pengaturan, misalnya mengatur soal penerapan penggunaan Informasi Teknologi (IT) di SPBU, serta tanda pengenal kepada pelanggan SPBU agar dapat membedakan mana pelanggan yang pantas menerima BBM subsidi atau tidak.




Selain itu, Andy mengaku kalau sejauh ini pihaknya, sudah menerbitkan berbagai peraturan lainnya untuk mengawasi penyaluran BBM subsidi agar tepat sasaran kepada pelaku usaha.




Juga termasuk melakukan kerjasama dengan pemerintah daerah dan aparat kepolisan guna meminimalisir terjadinya potensi penyelewengan penyaluran BBM subsidi.




"Kita sudah membuat aturan, tinggal bagaimana pelaku usaha menjalankan peraturan yang kami buat tersebut," kata Andy.




Lebih lanjut Andy mengaku, kalau tahun 2013 mendatang, pihaknya telah memberikan izin penyaluran BBM subsidi kepada dua badan usaha milik swasta yakni PT Surya Parna Niaga dan PT AKR Coorporindo Tbk, selain PT Pertamina (Persero).

Canada Approves Both Cnooc-Nexen, Petronas-Progress Deals

(883)'s $15.1 billion takeover of Nexen Inc. (NXY) and Petroliam Nasional Bhd.'s C$5.2 billion ($5.2 billion) takeover of Progress Energy Resources Corp. (PRQ)




The deal by Beijing-based Cnooc is the largest ever takeover by a Chinese company, according to data compiled by Bloomberg. It gives the state-owned company a stake in Canada's largest oil-sands project and the biggest position in the Buzzard oil field in the U.K. North Sea.




China is securing global reserves to feed demand in the world's second-largest economy, which accounted for half of the world's oil consumption growth in 2011, according to the U.S. Energy Information Administration. Harper, who has touted Canada as an emerging "energy superpower," has called it a national priority to diversify energy exports, sending less to the U.S. and more to Asia.




"It's important to have clarity on this, not just for Canada's foreign relations with certain super-power nations but also to ensure timely development of these very important resources," said Robert G. Gill, portfolio manager at Toronto- based Aston Hill Financial, which has more than C$6 billion assets under management.






Tested Ability




The two bids tested Harper's ability to balance the need to bolster economic relations with Asian economies without letting them gain too much influence over the world's third-largest pool of oil reserves.




"I express my appreciation for Canada's welcome of our investment," Wang Yilin, chairman of Cnooc, said today in a statement. The deal "recognizes the long-term economic benefits for Calgary, for Alberta and for Canada. Our company will also benefit by adding Nexen's impressive assets and outstanding employees to our worldwide operations."




While allowing the takeovers, Harper said Canada won't approve state-owned companies taking controlling interests in any more oil-sands projects, except in "exceptional circumstances."






Difficult Decisions




"These were difficult decisions" that reflect "the broad views of Canadians," Harper told reporters. Canada relies on exports for one-third of economic output and counts on energy products for almost one-quarter of those shipments.




"From a perspective of industry this is the perfect solution," said John Stephenson, who helps manage C$2.7 billion at First Asset Management Inc. in a phone interview from Toronto. "You get the benefit of patient capital servicing value for investors and you don't give up control, which is really the issue most Canadians feel passionately about."




Canada is effectively "grand-fathering the Cnooc and Petronas deals," Stephen Wortley, a partner at McMillan LLP and chairman of the Canadian law firm's Hong Kong office, said in an e-mail. "At the same time the government is signaling that tougher standards will be forthcoming especially in the oil sands, where there is a concern about the potential for concentration" of foreign state-owned companies, he said.






Shares Rally




Shares of Calgary-based Nexen rallied 15 percent to $26.94 as of 6:19 p.m. New York time in trading after U.S. exchanges closed, 2 percent below Cnooc's $27.50 offer. The Canadian dollar strengthened, rising 0.3 percent to 98.84 cents per U.S. dollar as the announcements were made.




The Cnooc-Nexen transaction is the biggest in Canada since Calgary-based Suncor Energy Inc. (SU) bought Petro-Canada in August 2009 for about $18 billion. Through its C$2.1 billion acquisition of Opti Canada Ltd. last year, Cnooc already owns 35 percent of the Long Lake oil-sands project operated by Nexen. It would gain Nexen's 20 percent interest in the Usan offshore Nigerian project operated by a unit of Total SA.






'Significant Benefits'




"This is an important milestone in the process and confirms our belief that this transaction provides a number of significant benefits to Canada and to Nexen," Kevin Reinhart, Nexen's interim president and CEO, said in statement. "We remain focused on working with Cnooc to bring this transaction to a close."




Progress shares (NXY), which surged 74 percent on the day the first bid by Petronas was announced June 28, closed at C$19.35 in Toronto. Petronas offered C$22 a share.




"We're obviously quite pleased with the decision," said Michael Culbert, chief executive officer of Calgary-based Progress, by phone. "We know that this has been a difficult decision to make and we don't take that lightly."




Azman Ibrahim, a spokesman for Petronas in Kuala Lumpur, couldn't immediately comment when phoned by Bloomberg News today.






LNG Terminal




The acquisition of Progress by Petronas gives the Malaysian state-owned company gas reserves to build a liquefied natural gas export facility along the British Columbia coast at a cost of C$9 billion to C$11 billion, the companies said this week.




Petronas has the world's largest LNG-producing site in Sarawak, Malaysia, according to its website, and also operates the world's largest LNG carrier fleet.




The Canadian decisions came on the same day Glencore International Plc (GLEN)'s C$6.1 billion takeover of Viterra Inc. (VT), Canada's largest grain handler, received Chinese regulatory approval.




Investment by Chinese state-owned companies in Canada's energy industry has become a contentious issue, and the deals represent the end of a trend of state-owned companies buying Canadian oil-sands firms, not the beginning, Harper said.




Still, the decision "will serve as a catalyst for inbound investment by Chinese private concerns into the Canadian market place," said Wortley at McMillan. "We are already seeing significant activity in this area."






'Irresponsible, Farce'




Fifty-eight percent of Canadians wanted the government to block the Nexen takeover, according to an online poll of 1,000 people taken Oct. 10 to Oct. 11 by Angus Reid Public Opinion.




The opposition New Democratic Party called the Cnooc approval "irresponsible" because most Canadians oppose the purchase. "This is a farce," Peter Julian, the NDP's spokesman on natural resources, said in a statement. "While Conservatives admit that under the new rules this transaction is not a net benefit to Canadians, they have approved it anyway."




Natural Resources Minister Joe Oliver has said the country's biggest resource projects will require nearly C$650 billion of investment to develop over the next decade.




Harper said Canada will raise the threshold for foreign- takeover reviews by private investors to C$1 billion in enterprise value as earlier planned, while the existing threshold of C$330 million in asset value will continue to apply to state-owned enterprises. Industry Minister Christian Paradis will also have the ability to extend the review period to take national security analyses into account, Harper said.






Gulf Assets




Foreign state-owned businesses will still be welcome to acquire minority stakes and enter into joint ventures with Canadian businesses, Harper said.




Cnooc, which said it received approval from the European Union today on the deal, has not said whether U.S. authorities have approved its takeover of Nexen's assets in the U.S. Gulf of Mexico, where the Calgary company gets eight percent of its production.




Natalie Earnest, a spokeswoman at the U.S. Department of the Treasury that oversees the Committee on Foreign Investment in the U.S., declined to comment in an e-mail, citing confidentiality rules.




Scrutiny of foreign takeovers has stymied deals in North America before. Cnooc was forced in 2005 to abandon a $19 billion hostile bid for El Segundo, California-based Unocal after U.S. lawmakers proposed legislation to block it.






Listing in Toronto




Cnooc had already made several commitments to Canada to win support for the Nexen sale. These include listing its shares on the Toronto Stock Exchange (SPTSX), establishing Calgary as its base for North and Central America and maintaining Nexen's employment levels and capital spending program.




Cnooc accepted management and employment conditions set by the Canadian government, two people familiar with the matter said Nov. 20.




The deal will also benefit Cnooc's domestic operations, allowing it to "transfer some of the shale gas and deep water expertise back into China," Gordon Kwan, head of energy research at Mirae Asset Securities HK Ltd., said by telephone. "Nexen's Gulf of Mexico assets will help Cnooc further develop South China Sea reserves."




Approval of the Petronas bid came after Paradis blocked the bid on Oct. 19 and gave the companies 30 days to make additional concessions.

WWW.EMLIINDONESIA.COM - Kementerian Energi Sumber Daya Mineral (ESDM) menyatakan saat ini ada perubahan paradigma migas Indonesia. Perubahan ini adalah bergesernya pengembangan migas dari onshore (laut dangkal) ke deep water atau laut dalam.




Dirjen Migas Kementerian ESDM Evita Legowo mengatakan ketika menjadi pembicara dalam acara Indonesia-Norwegia, kerjasama dengan Norwegia dalam pengembangan laut dalam penting karena negara itu memiliki banyak pengalaman. Di sisi lain, sebagian besar penemuan baru migas Indonesia berlokasi di laut dalam.




"Kami ingin belajar banyak dan investor Norwegia dapat menanamkan uangnya dengan mengembangkan laut dalam bersama kami," kata Evita dilansir situs resmi Kementerian ESDM, Jumat (30/11/2012).




Menurut Evita, sebagian besar migas laut dalam berlokasi di Indonesia Timur. Sejumlah kontrak kerja sama pengembangan laut dalam, juga telah ditandatangani dan Norwegia memiliki pengalaman yang cukup banyak dalam pengembangan laut dalam. Karena itu, pemerintah mengajak investor negara tersebut agar mau mengembangkan laut dalam di Indonesia.




Sebagai informasi, potensi sumber daya migas nasional tersebar dalam 60 cekungan sedimen (basin). Dari jumlah tersebut, sebanyak 22 cekungan belum pernah dilakukan kegiatan eksplorasi dan sebagian besar berlokasi di laut dalam. Ke-22 cekungan tersebut adalah Ketungau, Pembuang, Lombok Bali, Flores, Tukang Besi, Minahasa, Gorontalo, Sala Bangka, South Sula, West Buru, Buru, South Obi, North Obi, East Halmahera, North Halmahera, South Seram, West Weber, Weber, Tanimbar, Waropen dan Jayapura.

BP Temporarily Banned From Contracts With U.S. Government

The EPA said it imposed the ban because the company's conduct during the 2010 Deepwater Horizon disaster showed a "lack of business integrity." The action doesn't affect existing contracts, and BP said it already was working to get the ban lifted. The incident killed 11 people and caused the largest environmental disaster in U.S. history, it said.




BP on Nov. 15 reached a settlement with the Justice Department, agreeing to pay $4.5 billion to end all criminal charges and resolve securities claims relating to the Gulf explosion. At the time, the company said it hadn't been advised of any government action on contracts and specialists said it might escape even a temporary ban.




The suspension "sends the signal to BP, and incidentally to the whole oil and gas drilling industry, that the United States will take strong steps to protect itself against a recurrence of that tragedy," said Charles Tiefer, a law professor at the University of Baltimore who focuses on government contracting.






'Negative Mark'




"BP quite likely did more damage to the United States than any other federal contractor that I can remember, in terms of inflicting many billion dollars of environmental harm and destruction," he said.




Tiefer, who served on the U.S. Commission on Wartime Contracting, added that the EPA's action will "take a toll" on BP. Even after the suspension expires, BP may have "an extremely negative mark" with the U.S. government, which includes a contractor's past performance as part of its evaluations for awards, he said.




While the EPA didn't say how long the ban would last, suspensions generally don't exceed 18 months or until the end of legal proceedings.




In a statement, the company said it was working with the EPA to demonstrate "present responsibility" so it can have the suspension lifted.




"BP has been in regular dialogue with the EPA and has already provided both a present responsibility statement of more than 100 pages and supplemental answers to the EPA's questions based on that submission," it wrote.






Proposed Agreement




The agency has informed BP that it is preparing a proposed agreement that "would effectively resolve and lift this temporary suspension," it said. "The EPA notified BP that such a draft agreement would be available soon."




BP shares fell less than 1 percent to close at 429.4 pence in London. They had dropped as much as 2.9 percent after the suspension was announced.




BP produces about 770,000 barrels of oil equivalent a day in the U.S., more than 20 percent of the company's global output. BP had revenues of $131 billion in U.S. last year, more than a third of its global total.




The company in fiscal year 2011 was the Defense Department's biggest fuel supplier with awards valued at about $1.35 billion. Its contracts with the military surged 33 percent from $1.02 billion in the previous year, according to data compiled by Bloomberg.




Defense Contracts




The firm received 49 percent more in defense contracts in 2011 than the No. 2 fuel supplier, San Antonio-based Valero Energy Corp. (VLO) BP won a $782 million Pentagon award for fuel in May even as it continued to face legal challenges. Full fiscal 2012 figures aren't yet available.




"The suspension of BP is surprising and a win for holding all companies, big or small, accountable to the federal government and taxpayers," said Scott Amey, general counsel for the Washington-based Project on Government Oversight.




Amey questioned whether the government could put BP "in timeout" because it is a top federal contractor supplying petroleum products to the Pentagon.




"Let's see how long the suspension lasts or if the military grants any waivers," he said.




The company will be able to seek permits to drill on parcels for which it has already been awarded leases in previous auctions, said Tommy Beaudreau, director of the U.S. Bureau of Ocean Energy Management.






Oil Leases




BP didn't bid in an auction for offshore oil leases that were opened today, Beaudreau said. The leases give winning bidders the right to seek permits to drill in sections of the Gulf of Mexico. The agency said the company wouldn't have been awarded any of the leases even if it had been the high bidder, due to the temporary ban.




"That suspension applies only to new contracts with the federal government and does not apply to activities under BP's existing leases." Beaudreau said.




News of the suspension follows a Nov. 23 announcement that Lamar McKay, head of BP's U.S. operations, will move to London to become chief executive officer of the company's exploration and production unit called Upstream. McKay will report to Chief Executive Officer Bob Dudley.




"This signal from the U.S. on management integrity has real significance," said Peter Hutton, an analyst for RBC Capital Markets.






Boeing Ban




The critical question is whether this is "a shot across BP's bows to get settlement, or a more sustained stance," he said.




Large companies or their divisions have been suspended or debarred in the past. The Air Force in 2003 suspended three units of Boeing Co. (BA) in response to allegations that several former employees conspired to steal trade secrets from Lockheed Martin Corp. (LMT) during a competition. The suspension was lifted in 2005.




"When someone recklessly crashes a car, their license and keys are taken away," said Massachusetts Representative Edward Markey, the top Democrat on the House Natural Resources Committee. "The wreckage of BP's recklessness is still sitting at the bottom of the ocean and this kind of time out is an appropriate element of the suite of criminal, civil and economic punishments that BP should pay for their disaster."
